1. Acceptance of Terms
By engaging the services of The Photos Factory (TPF) or accessing our website, you agree to
be bound by these Terms of Service. These terms govern the relationship between you (the Client) and TPF. If
you do not agree with any part of these terms, please inform us before confirming your booking.
2. Service Scope
The Photos Factory specializes in premium visual storytelling. Our primary service offerings include:
- Photography Services: Weddings, pre-weddings, baby shoots, and portraits.
- Videography Services: Cinematic event coverage, highlights, and traditional videos.
- Event Coverage: Full-scale documentation of celebrations and corporate events.
- Destination Shoots: Travel-based assignments across various locations globally.
3. Booking Policy
To ensure a smooth planning process, all our bookings follow a structured procedure:
- Confirmation Process: A booking is considered confirmed only when the agreed advance
payment is received, and a formal acknowledgment is sent by our team.
- Advance Payments: A non-refundable advance payment is required to lock your dates. Verbal
commitments do not guarantee date reservations.
- Date Locking: Once dates are locked, we reject all other inquiries for that specific
timeframe to dedicate our resources entirely to your event.
4. Payment Policy
To ensure smooth event planning, all payments follow a structured 3-instalment schedule:

At the Time of Booking — Non-refundable advance to secure and lock your
date.

On the Event Date — Paid before the shoot begins on your special day.

After Deliverables Are Delivered — Final payment once edited photos/videos are
received.
- Quotation-Based Pricing: Final pricing is provided via a customized quotation based on
your specific requirements, event scale, and duration.
- Custom Packages: We tailor our packages to suit your vision, ensuring you only pay for
the services you need.
- Travel Charges: For destination shoots or venues outside our standard operating radius,
travel, accommodation, and related logistical charges will be billed additionally unless explicitly included
in the package.
5. Client Responsibilities
A successful shoot is a collaborative effort. As our client, you are responsible for:
- Timing Coordination: Ensuring that events run reasonably close to the agreed schedule.
TPF is not responsible for missed moments due to significant delays.
- Permissions & Clearances: Securing any necessary photography permits or clearances
required by the venue, authorities, or event management.
- Venue Access: Providing our team with appropriate access, space, and a safe working
environment to capture your event efficiently.
6. Intellectual Property Rights
We take pride in our art. The intellectual property of the creative work remains with TPF:
- Ownership: All raw and edited images, videos, and creative assets produced by TPF remain
our intellectual property unless a full copyright buyout is agreed upon in writing.
- Unauthorized Reuse: Re-editing, applying third-party filters, or commercializing our work
without explicit written consent is strictly prohibited. You are granted a license for personal,
non-commercial use.
7. Portfolio Rights
We rely on our previous work to showcase our talent to future clients. By hiring TPF, you agree that we may
display selected media from your event on our website, social media, and marketing materials. If you require
complete privacy, this must be requested and documented prior to booking.
8. Delivery Timelines
Quality takes time. We meticulously edit every photo and video to ensure cinematic perfection. Estimated
delivery timelines for edited photos and videos will be clearly stated in your contract. While we strive to
deliver ahead of schedule, timelines may vary slightly during peak wedding seasons.
9. Limitation of Liability
While we prepare meticulously for every event, certain circumstances are beyond our control. TPF shall not be
held liable for delayed or hindered service resulting from:
- Weather Conditions: Rain, storms, or inadequate natural lighting.
- Travel Delays: Flight cancellations, traffic, or transportation failures.
- Technical Issues: Sudden equipment failure or data corruption, despite our rigorous
backup protocols.
- Force Majeure: Natural disasters, pandemics, or government-mandated lockdowns.
10. Third-Party Platforms
We use third-party platforms (such as WhatsApp, Google Maps, and social media) for communication, logistics,
and delivery. TPF is not responsible for any service interruptions, data breaches, or policy changes initiated
by these external platforms.
11. Changes to Terms
TPF reserves the right to modify or update these Terms of Service at any time. Changes will be posted on this
page. By continuing to use our services after any changes, you accept the revised terms.
